Utah state court nullifies co-parenting contract, denies lesbian woman parental rights after the biological mother 'found Jesus,' married a man.

The case highlights the predicament of same-sex parents in Utah, a state where gay and lesbian couples cannot marry, adopt children or even expect their own contracts for shared parenting and guardianship to stand in court.

Such documents did not protect Edvalson, who signed co-parenting and co-guardianship agreements with Dickson near the time the baby was born.

Although this case is "not binding precedent," Edvalson's Salt Lake City attorney, Lauren Barros, said she wouldn't recommend a co-parenting agreement to other same-sex couples.

"It was my last hope," Barros said. It didn't work.


This is why gay and lesbian couples need the legal kinship rights of marriage and adoption. Without them, we're legal strangers, and any christian hate crusader like attorney Frank Mylar can come in and take our families away from us.

There are only two ways to be legally related in this country: by ties of blood, or through the legal declaration of kinship via marriage or adoption. That's it. Co-parenting agreements, reciprocal beneficiaries, and domestic partners do not a legal family form. People who oppose legal protections for gay families in the form of marriage and adoption like to tout the lie that private contracts will provide the same protections. As we see here, no, they don't.

Private contracts of any sort can be nullified by the state, and are broken all the time in civil court. Laws of next-of-kin can be invoked by a greedy, spiteful birth family to contest and break a will, hospitals can deny visitation despite durable POAs because "you're not really family," and through it all, christian hate groups will stand by and say that they're just trying to protect the children.

Utah is an evil place, and I will never go there.

Otakon 2k9 Sunday: Last Gasp [19 Jul 2009|11:12am]

Just a quickie. Went over to the con to see Afro Samurai Resurrection; Jen and Andy went to the steampunk panel. Both were awesome although for the life of me I don't get why Otakon staffers leave the overhead lights on in a video room. It washes out the screen.

Aaand... that's it. We're packing up now to head home. I'm eager to get back to the real world; this has been a very odd, offbeat con. Fun, but indirectly so. I wanna get back to my relaxing apartment, play some games, do some writing.

I'll photograph my swag later for assistance in identifying what I actually bought.

Otakon 2k9 Saturday: The Sickness Takes Hold [18 Jul 2009|09:03pm]

Con-rot has set in. Either that or the cold Jen contracted last week was passed on to us; Andy and I both woke up ill today -- congested, headache, etc. We immediately obtained Dayquil but it still managed to take the wind from our sails.

Fortunately, I had very little plans for today. Wake up late, do a quick dealer's crawl perhaps, then AMVs. For a change I stuck with Jen and Andy today instead of striking out on my own; we did everything as a group, which was fun indeed. Even got some Food Court of Doom chow and the largest ice cream I've had to tangle with. Still, it was a thin day that we ended early since everybody was so tired.

The AMVs themselves were kinda meh. I know I keep slamming Otakon and claiming I'm having fun anyway, and it holds true here -- we enjoyed watching AMVs in general, even if none of them really grabbed us and made us go "YES! AWESOME!". It did tune me into some anime that looked visually interesting, like Soul Eater and K-On!, so I'll have to look into those... but the rest, eh.

Tomorrow we gotta wake up early... Jen and Andy for a steampunk costuming panel, me for Afro Samurai. Then we'll head home and recouperate.

I think it's definitely our last Otakon for awhile. Just being here is a nice treat, but it's clear we're not getting much out of the con itself, just the con atmosphere and the con feature sets. We'll be trying PAX East next year; maybe gamer-flavored conning will be more to taste.

We do a fair amount of complaining about rude customers, but at my restaurant, our customers are rarely rude and so I have nothing to contribute to this fine community. My issue, however, is with our bussers/server assistants, or SAs. Or... just one in particular. Let's call her C.

I work on a dinner cruise and our start time is usually an hour and a half before our customers board. My manager told me that the SA for my section was C, who is easily the least liked person on our boat. C does not show up until ten minutes before customers board and I had to get some other SAs to do her job because she was late and I was very busy.

She finally meanders her way onto the boat and announces to me, "Amanda! I hope you make some good money tonight! I need cigarettes!!" followed by horrible, maniacal laughter that makes everyone cringe. Oh, okay. I too hope she has enough money for cigarettes because I am sick of her bumming them off of me.

Once our customers start to board, she just stands there. She would clear a few plates (usually while people were still eating off them) and then ask me, "What do you want me to do now?" Bitch, you have worked here for five months. I am extremely busy and I don't have time to think about what I need to do and what you need to do. You should know what to do! Refill water glasses, clean the coffee station, clear empty place settings, FUCKING DO SOMETHING and don't ask me about it. I told her this very nicely and she got uppity.

C has worked at my restaurant for five months, is totally unfamiliar with table numbers, but insists on dropping food, even when I tell her not to because, as you can well imagine, she drops meals off at the wrong tables. Not to mention the fact that I went over every single table number in our section to her earlier in the shift to make sure that sort of thing didn't happen (which, of course, it did).

C becomes fed up with my "attitude" and tells the hostess (who doesn't like her at all) about it. "I'm not fucking helping Amanda!! She can do her shit herself!" Three full tables hear her and complain to our manager about her language. This brings up another point: Why would you refuse to help someone who is responsible for paying you at the end of the night? Because I don't care one way or another if you help me.

Table 1212 is finished with their entrees, so I clear their plates as I begin my usual post-meal small talk. 1212 is a talkative couple, so I balance their empty plates on my hip as we chat. C comes up to me and literally starts grabbing the plates out of my hand. "Don't worry about it, C, I'll take care of it." She responds: "No, it's okay, I got it." By this point, she's interrupted the conversation. I tell her, "No, C, I told you. It's fine. I will take care of it." She doesn't give up: "No no no, I'll take them." Really now? Really? "Seriously, C. I will take care of it." AKA: GO THE FUCK AWAY.

One of the most important times for the SAs to physically be on deck is during dessert time because it's their responsibility to take coffee orders. C is nowhere in sight. I take all the coffee orders and distribute the beverages myself.

In fact, I did not see C for the entire last hour of the cruise (our cruises typically last three hours). And I'm not exaggerating. She was upstairs for the last hour. "Washing silverware." Oh, because washing silverware is totally first priority when there are paying customers dining below.

By this point, word had gotten around to me that C shit-talked, for a lack of better phrase, me in front of my customers. I am far from pleased and I keep it in mind. Our customers leave and I clear my tables completely (with no help from C. Remember? The silverware that we don't need until Monday needs to be washed!!!!). Typically, servers are supposed to give 20% of their total tips to their SAs. This isn't set in stone, however (I've even given half my tips to an SA in the past). I decided to be generous and give C $6 even though $11 would have been 20%. She didn't deserve any tips whatsoever, but I didn't feel like being confronted.

As I'm getting ready to leave for work, C walks by me and says, "Five dollars? The fuck am I gonna do with five dollars?"
"It's six, bitch!"



tl;dr--I hate bussers so much sometimes. Does anyone else have terrible bussers/server assistants? I just needed a good rant, I'm not normally this pissy!

Otakon 2k9 Friday: Nothing Goes According To Plan (But Is Not Ruined) [17 Jul 2009|11:17pm]

My plan for the day was to start off at Slayers, which would hopefully be the new series airing in Japan, and if not I could go to Casshern Sins which looked interesting. Then quickly off to the "Making an Anime RPG" workshop, which was going to be 3 hours long, leading into She-Cat Gambler which was described as the sequel to the bloodtastic ninja revenge flick Lady Snowblood, then finally Evangelion and the Fan Parodies.

Every single event was rife with absolute fail. But, I made the most of it. More behind this link. )

So here I am, three o'clock in the morning, giddy as a sailor on shore leave.

Scratch that, I have not been this euphorically incomprehensible since a specific night back in September 2006. This is no exaggeration--I was actually hyperventilating (quietly) for roughly an hour after I heard about it (which, unfortunately, was about half an hour before work was up). I then spent the next couple of hours calling up people and talking about it enthusiastically.

Anyone who knows me or has seen the tags below and are interested know what I'm talking about--the Rock Band Network.

A brief summary:

  1. Artists record their songs and submit the master tracks (separated as per the norm--guitar, bass, drums, vox, other sounds) to trained third-party developers.

  2. These developers (Harmonix already has a group of developers trained, but apparently the program is open to anyone who can be trained) will then use Harmonix's in-house tools to script and track each song, instrument by instrument. These tracks then get submitted for peer review (for technical errors, not artistic merit) before officially being published.

  3. ???

  4. Revenue! 30% of the track sales go back to the artist.

This is, pun unavoidable, a game changer. This is very much a reach-for-the-stars moment for the Rock Band platform, a giant middle finger to GHTunes and Activision's "we have 2000 people charting notes for Guitar Hero", and surely some form of madness. The more people Harmonix trains, the faster content can get out there, and the emptier our wallets will become. I can see labels having their own in-house tracking staff, and potentially studios (small groups-of-five operations, likely) arising specifically to handle these kinds of jobs.

This is the kind of scene that has me interested. AMVs? MIDI sequencing? It all ends up here.

I've signed up to be part of the creators' beta, which I am led to understand means the track authoring. This is the opportunity I've been looking for--to see if this is something I want, to see if this is something I can handle. I don't know if I'll get in, but Lord knows this is the kind of thing I've dreamed about, as a musician, a Rock Band enthusiast, and a music transcriber. This will keep me walking on sunshine for the next few weeks.

Just be prepared to be sick every time I open my mouth, because I have the feeling I won't shut up about this any time soon, particularly when I get my hands on Reaper and Magma, the programs used to design the tracks. And don't say I didn't warn you.

Today you came in O'Charleys and said there would be four of you and that your final person would be along shortly. You ordered an appetizer then three of our 7oz steaks for 9.99 each. You drank tea like it was going put of style. After all three of you had finshed eating--appetizer, salads and all-- you asked for boxes. Then your joiner came. An hour and a half after you sat down. Then one of your grabby hands pulled me down and you proceeded to whisper that it was someones birthday, breathing your nasty smoker breath all over me. I brought a piece of cake for you and you finally left after over two hours. Your check was 62 dollars including the cake I had comped for you. Five dollars was not an adequate tip for your bullshit.

In...other news, this week was a wash. While I should have been packing, I've been stuck here waiting on rides to come, early morn and late night. While I should have been at work handling a client case, I've been waiting on rides. While I should have been maintaining zen less I lose my frail mind, my loving semi-nephew decides it's a great idea to attempt to prank the one person out of all of us whose physical reactions are "Eradicate first, ask questions later". And instead of people talking rationally, I got to talk someone down from Yet Another Senseless Fight (2nd one of the year!)

And now when I'm like, "screw you guys I'm just gonna chill if I can't get my--wait no YOUR business done," someone decides they want to volunteer me for a paint job I'm not getting paid for.
